“In 1998, Congress passed the Digital Millennium Copyright Act (DMCA), which amended U.S. copyright law to address important parts of the relationship between copyright and the internet. The three main updates were: (1) establishing protections for online service providers in certain situations if their users engage in copyright infringement, including by creating the notice-and-takedown system, which allows copyright owners to inform online service providers about infringing material so it can be taken down; (2) encouraging copyright owners to give greater access to their works in digital formats by providing them with legal protections against unauthorized access to their works (for example, hacking passwords or circumventing encryption); and (3) making it unlawful to provide false copyright management information (for example, names of authors and copyright owners, titles of works) or to remove or alter that type of information in certain circumstances.”

Our policy is to respond to the notices of alleged copyright infringements that comply with the Digital Millennium Copyright Act (DCMA). Copyright infringing materials found on at this site, or bernTUNES.com or its companion eCommere platform, bernTUNES.shop can be identified and removed via the website’s DMCA compliance process listed below provided that compliance with such process verifies allegations made. Effort will not be spared to uphold the rights of the actual copyright owner.
Please note though that we do not make any legal decisions about the validity of your claim.
If you are the author of the article or other content published on here or at any site controlled by bernmeister.com and you want your work or content removed, please send a request with your name, title of your work, location of your work (i.e. URL address or database) and specific removal instructions.
We will remove the allegedly infringing content or block access to it if it receives a clear and valid Notice pursuant to the guidelines set forth below. The Notice provider may be requested to provide additional information to further justify the validity of the claim.

Notice and Procedure for Making Claims of Copyright Infringement Pursuant to the Digital Millennium Copyright Act.
- A statement that you are the owner of the exclusive right you claim has been infringed, or a statement that you are authorized to act on behalf of the owner of an exclusive right that has allegedly been infringed.
- A statement, under penalty of perjury, that the information in the notification is accurate. It is preferable that the statement be notarized, but we will consider accepting one otherwise if same is required by law,
- Your signature. (sign the notice with either a physical or electronic signature). It is preferable that the signature be original, preferably in ink, in a color (e.g., blue) different from the text (e.g., black); however, we will accept an electronic signature if required to do so by law.
- The identification of the copyrighted work you claim has been infringed. (If you claim that multiple copyrighted works have been infringed you can submit one notification with a list of the allegedly infringed works.)
- Identification of the material that you claim to be infringing and information reasonably sufficient to permit us to locate the material, including but not necessarily limited to the website page where such infringing material can be found.
- Information reasonably sufficient to permit us to contact you, including your address, telephone number, fax number and, if available, an electronic mail address.
(We will only use this information to address the complaint with the individual accused of infringing, our attorneys, and the courts as required. The information will not be used, or provided to others for use, for any other reason.}
- You can provide contact information for the owner of the exclusive right that you claim has been infringed if you are not the owner, but rather authorized to act on behalf of the owner.
- A statement you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
